1. GENERAL

(1) These Terms & Conditions (T&C) apply to all contracts concluded via the online shop of ONLYDIRTFANS, Vierhausstr. 92, 44807 Bochum, Germany (hereinafter: ODF) under the domain onlydirtfans.com with customers (hereinafter: CUSTOMER).

(2) These T&C contain specific provisions for business customers (B2B) within the meaning of Sec. 14 German Civil Code (BGB). Such provisions are expressly marked and do not apply to consumers (B2C) within the meaning of Sec. 13 BGB.

(3) Deviating terms of the CUSTOMER do not apply unless ODF has expressly confirmed them in writing.

2. CONTRACT CONCLUSION

(1) The CUSTOMER may place products in the shopping cart via the respective button and start the checkout process. After entering all necessary contact and payment details, the CUSTOMER completes the order by clicking “Buy Now”.

(2) Input errors (e.g. products added by mistake) can be corrected in the shopping cart or during checkout using the browser’s “Back/Forward” navigation.

(3) The presentation of products in the online shop does not constitute a legally binding offer, but merely a non-binding invitation. By submitting an order, the CUSTOMER makes a binding offer.

(4) Receipt of the order is confirmed automatically by email. This confirmation is not yet acceptance. ODF may accept the offer within 5 calendar days (or 3 working days) by separate acceptance email or by dispatch of the goods. Only then is the contract concluded. Issuing an invoice is equivalent to acceptance.

(5) The contract is concluded with ONLYDIRTFANS, Vierhausstr. 92, 44807 Bochum, Germany. Contract language is German or English.

3. STORAGE OF CONTRACT TEXT

The contract text is stored by ODF. Order details are sent separately to the CUSTOMER in text form (email). The T&C can also be accessed and printed from the shop at any time.

4. RIGHT OF WITHDRAWAL

Consumers are generally entitled to a statutory 14-day right of withdrawal. Details are provided in the Cancellation Policy, which is available during checkout.

5. PRICES & SHIPPING COSTS

(1) Prices displayed on the day of the order apply. All prices are in Euro (€) and include VAT.

(2) Shipping costs are charged separately unless stated as free shipping. They are shown transparently in checkout. For details, see onlydirtfans.com/policies/shipping-policy.

(3) For cross-border deliveries, additional taxes or duties may apply (e.g. customs), payable by the CUSTOMER.

6. PAYMENT TERMS

(1) Only the payment methods offered during checkout are accepted (e.g. credit card, PayPal, Apple Pay, Google Pay, Klarna, SEPA).

(2) By selecting an online payment option, the CUSTOMER authorizes ODF or its payment provider to collect the invoice amount. Strong Customer Authentication (SCA, e.g. 3-D Secure, TAN, biometric) may be required.

(3) If “purchase on account” or installment payments are offered, the terms of the respective provider apply and are displayed in checkout.

(4) Set-off rights are available to business customers only if claims are legally established, undisputed, or acknowledged by ODF. This restriction does not apply to consumers.

7. VOUCHERS

(1) Gift vouchers (purchased for a fee) are provided digitally with a code, valid for 3 years from the end of the year of issue. They are transferable, redeemable only in the ODF shop, and cannot be exchanged for cash.

(2) Promo vouchers (issued free of charge during campaigns) are voluntary, limited in time, and cannot be refunded or credited if goods are returned.

(3) Copying, editing, or tampering with vouchers is prohibited. ODF accepts no liability for lost, stolen, or unreadable vouchers or for errors in the recipient’s email address.

8. DELIVERY & SHIPPING

(1) Delivery is made to the address specified by the CUSTOMER via postal services or courier. Delivery to Packstations is only possible if offered in checkout.

(2) Delivery times are displayed on the product detail page.

(3) In case of advance payment, the period starts on the working day after the payment order; for other methods, on the working day after order confirmation.

(4) Risk transfer:

– For business customers, risk passes upon handover to the transport company.

– For consumers, risk passes upon delivery to the CUSTOMER (§ 446 BGB).

(5) If delivery fails and goods are returned to ODF, the CUSTOMER bears the cost of reshipment, unless exercising a withdrawal right or if not responsible for the failure.

9. RETENTION OF TITLE

Goods remain the property of ODF until full payment is received. Before ownership passes, pledging or assigning as security is not permitted.

10. WARRANTY / DEFECT LIABILITY

(1) Statutory defect rights apply.

(2) Business customers must inspect goods and notify ODF of defects in writing within 14 days (§ 377 HGB). This does not apply to consumers.

(3) For business customers, warranty claims expire after 12 months from delivery. This does not apply to consumers, cases of intent, gross negligence, fraudulent concealment, injury to life/health, or product liability.

11. LIABILITY

(1) Claims for damages are excluded unless based on intent or gross negligence by ODF, its employees, or agents.

(2) Liability under the German Product Liability Act remains unaffected.

(3) In cases of negligent breach of material contractual obligations (cardinal duties), liability is limited to foreseeable, typical damages.

12. DATA PROTECTION

The Privacy Policy of ODF applies: onlydirtfans.com/policies/privacy-policy.

13. ODR PLATFORM

Consumers may use the EU’s Online Dispute Resolution (ODR) platform:

14. DISPUTE RESOLUTION (§ 36 VSBG)

ODF is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. FINAL PROVISIONS

(1) German law applies under exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For consumers, this choice of law applies only insofar as no mandatory consumer protection laws of the country of residence are infringed.

(3) Jurisdiction: For business customers, jurisdiction is the registered seat of ODF (Bochum, Germany).
